Candidate Matches & Premium Talent Search Terms

This document contains the terms relating to the following three services:
our complimentary Candidate Matches service (Candidate Matches Terms and Conditions);
our Basic Talent Search service (Basic Talent Search Terms and Conditions); and
our paid, Premium Talent Search service (Premium Talent Search Terms and Conditions).
If you have purchased Premium Talent Search, you will also have access to the complimentary Candidate Matches service, and both the Candidate Matches Terms and Conditions and Premium Talent Search Terms and Conditions will apply to you. You will not have access to Basic Talent Search while you have access to Premium Talent Search under a Commercial Agreement (previously known as an Advertising Agreement or Sales Agreement) with us.
If you are a verified hirer without access to Premium Talent Search service, you will have access to both the complimentary Candidate Matches service and the Basic Talent Search service, and both the Candidate Matches Terms and Conditions and Basic Talent Search Terms and Conditions will apply to you.
The table below provides a high-level summary of these three services available to you, including how each service is accessed, the types of candidate search and connection features available, and the usage currencies that apply.
This overview is only intended to assist your understanding of the different products. The detailed terms and conditions for each service are set out below and will apply in full. In the event of any inconsistency between this overview and the detailed terms, the detailed terms will prevail.

Part A: Candidate Matches Terms and Conditions
1. These Candidate Matches Terms and Conditions (CM Terms) apply to our complimentary Candidate Matches service.
2. The complimentary Candidate Matches service allows you to proactively identify and connect with potential candidates for your advertised roles. For each Qualifying Job Advertisement you post on the SEEK, JobStreet by SEEK (excluding JobStreet Express) and JobsDB by SEEK employment websites and apps (collectively, our websites and apps), we will:
a. recommend up to 100 candidates from our database for your role (Recommended Candidates). Depending on the combinations of your Qualifying Job Advertisement, for example, role title and/or location, the number of Recommended Candidates may be less than 100 candidates. To increase the number of Recommended Candidates for that role, you should broaden the role title and/or location; and
b. issue complimentary Candidate Invitations that you can use to connect with the Recommended Candidates through the Connection Methods.
3. We also offer other candidate search services:
a. Basic Talent Search: a service that provides verified hirers with monthly connections to search and connect with candidates (see Part B below);
b. Premium Talent Search: our premium, paid version of candidate search tools with increased functionality (see Part C below).
4. If you have access to Basic Talent Search:
a. you will also have access to the complimentary Candidate Matches service and these CM Terms apply to you in addition to the Basic Talent Search Terms and Conditions (see Part B below); and
b. you are entitled to use both the Candidate Matches service described in these CM Terms and the Basic Talent Search service.
5. If you have access to Premium Talent Search:
a. you will have access to the complimentary Candidate Matches service and these CM Terms apply to you in addition to the separate Premium Talent Search Terms and Conditions (see Part C below);
b. you are entitled to use both the Candidate Matches service described in these CM Terms and the Premium Talent Search service; and
c. you will not have access to the Basic Talent Search service while you have access to Premium Talent Search under a Commercial Agreement.
6. These CM Terms will bind both the relevant individual and any business or organisation they represent (or claim to represent) and references to "you" and "your" (and related terms) should be read accordingly.
7. These CM Terms are incorporated into the Advertising Terms of Use, which also apply to you. This means that relevant provisions in the Advertising Terms of Use (such as those relating to contracting parties and governing law) also apply to these CM Terms
8. For the purposes of these Terms:
a. Candidate Invitations means the number of candidate invitations allocated to you based on the Qualifying Job Advertisement that you have purchased which can be used to access the Connection Methods available within the complimentary Candidate Matches service.
b. Candidate Profile means a SEEK/JobStreet/JobsDB candidate profile that provides personal information about that candidate that may include (amongst other things) the candidate’s name, contact information and work history.
c. Connection Methods mean:
Send Message; and
Send Job.
d. Daily Limits is defined in clause 14.
e. Job Advertisement means a current job advertisement posted on our websites and apps.
f. Qualifying Job Advertisement means a Job Advertisement of the following types (as defined in the Product Terms and Conditions): Basic Ad, Basic Branded Ad, Advanced Ad, Advanced Branded Ad, and Premium Ad.
g. SEEK Group means SEEK Limited (ABN 46 080 075 314) and its related bodies corporate, as defined by the Australian Corporations Act 2001 (Cth). References to "we" and "us" (and related terms) mean the SEEK Group unless otherwise stated.
h. Send Job is a Connection Method that allows you to invite a candidate to apply for a particular Job Advertisement by electronically sending that Job Advertisement to that candidate.
i. Send Message is a Connection Method which allows you to send an electronic message to a candidate. You do not need to purchase a full Candidate Profile to send a Send Message.
9. You can only use this Candidate Matches service directly through our website. If you are posting job advertisements through a recruitment software provider, you will not be able to use this service through your Applicant Tracking System. We will issue you with Candidate Invitations for each Qualifying Job Advertisement you post on our websites and apps. The number of Candidate Invitations you receive depends on the type of Qualifying Job Advertisement you have purchased as detailed during your purchase process. You can check the balance of your remaining Candidate Invitations via your SEEK employer account.
10. Subject to the Daily Limits, you may use the Candidate Invitations issued under these CM Terms to access the Connection Methods in relation to the Recommended Candidates for the related Qualifying Job Advertisement.
11. The Candidate Invitations issued under these CM Terms:
a. can only be used in relation to the Recommended Candidates for the Qualifying Job Advertisement for which the Candidate Invitations were granted;
b. cannot be transferred to another party; and
c. expire when the relevant Qualifying Job Advertisement expires or is otherwise removed from our websites and apps.
12. The number of Candidate Invitations required for each Connection Method is as follows:
a. Send Job – 1 Candidate Invitation
b. Send Message – 1 Candidate Invitation
13. Candidates decide how much of their Candidate Profile is visible through Candidate Matches, if any (please refer to the "Visibility Settings" section of our Privacy Policy). You understand and acknowledge that a candidate's visibility settings may impact what Connection Methods are available to you.
14. Your use of the Connection Methods will be capped as follows (Daily Limits):

15. You agree to use the Candidate Matches service and the information you obtain through the service:
a. for the purposes of the hiring process for the employment opportunity advertised in the Qualifying Job Advertisement for which you received Candidate Invitations; and
b. in strict compliance with our Advertising Terms of Use, which includes complying with all Applicable Laws, including but not limited to, applicable Privacy Laws and anti-spam laws (capitalised terms as defined in the Advertising Terms of Use).
16. You must not use Candidate Matches (including the Connection Methods) or any candidate information obtained through Candidate Matches for:
a. soliciting business from candidates and/or promoting your business or the products or services you offer other than in relation to a genuine hiring process;
b. general marketing or sales outreach;
c. scraping, harvesting, bulk-downloading or otherwise systematically copying Candidate Profiles or any personal information about candidates;
d. exporting any candidate data or Candidate Profiles obtained via Candidate Matches outside our websites and apps, including into other databases, systems, or tools; or
e. contacting the same candidate across multiple hirer accounts in order to circumvent any limits or restrictions that apply to Candidate Matches.
17. If we detect activity in breach of clauses 17 or 18, we reserve the right to immediately:
a. remove any live job advertisements you may have placed on our websites and apps; and
b. cancel your Candidate Invitations.
18. We may make changes to, or cease to offer, the complimentary Candidate Matches service under these CM Terms (including features or functionality). We will publish notice of such actions on our website. For the avoidance of doubt, the variation of terms provisions in the Advertising Terms of Use do not apply to these CM Terms.
Part B: Basic Talent Search Terms and Conditions
1. These Basic Talent Search Terms and Conditions (Basic TS Terms) apply to our Basic Talent Search service.
2. Basic Talent Search is available to verified hirers who do not have access to Premium Talent Search. While you have access to Basic Talent Search, you will also have access to the complimentary Candidate Matches service and both the Candidate Matches Terms and Conditions (see Part A above) and these Basic TS Terms will apply to you.
3. If you subsequently purchase Premium Talent Search, your access to Basic Talent Search will cease and only the Premium Talent Search Terms and Conditions will apply to you (in addition to the Candidate Matches Terms and Conditions). Any unused Basic TS Connections will be forfeited and will not be converted, credited, refunded or rolled over.
4. These Basic TS Terms will bind both the relevant individual and any business or organisation they represent (or claim to represent) and references to "you" and "your" (and related terms) should be read accordingly.
5. These Basic TS Terms are incorporated into the Advertising Terms of Use, which apply to you. This means that relevant provisions in the Advertising Terms of Use (such as those relating to contracting parties and governing law) also apply to these Basic TS Terms.
6. All terms defined in the Candidate Matches Terms and Conditions (see Part A above) have the same meaning in these Basic TS Terms.
7. Basic TS Connections means the connections allocated to you under the Basic Talent Search service that can be used to access the Basic TS Connection Methods.
8. Basic TS Connection Methods means:
Send Message; and
Send Job.
For the avoidance of doubt, Basic TS Connection Methods do not include Access Profile or any method that provides access to a candidate's CV or direct contact information (such as phone number or email address).
9. Basic TS Daily Limits means the following caps to your use of the Basic TS Connection Methods:

10. Monthly Allocation means the number of complimentary Basic TS Connections issued to you on the first day of each calendar month at our discretion. See clauses 20 to 25 for more information.
11. Verified Hirer means a hirer who has completed our verification process and whose verification status remains current. Verification requirements and processes may vary by country and are determined by us from time to time. We reserve the right to revoke verification status at our discretion if we determine that you no longer meet our verification criteria or have breached these Terms.
12. To access Basic Talent Search, you must:
a. be a Verified Hirer; and
b. not have access to Premium Talent Search.
13. You do not need to have a current Job Advertisement or Qualifying Job Advertisement to use Basic Talent Search.
14. Basic Talent Search allows you to:
a. search Candidate Profiles across our database, subject to candidate visibility settings and location restrictions as described in clause 15;
b. use your Basic TS Connections to connect with candidates who appear in your search results through the Basic TS Connection Methods (subject to the Basic TS Daily Limits); and
c. continue to access the complimentary Candidate Matches service in accordance with the Candidate Matches Terms and Conditions (see Part A above).
15. The Candidate Profiles you can access through Basic Talent Search are determined by:
a. the visibility setting the candidate has selected within their account with us; and
b. the location you are searching. A candidate will only be visible when you are searching for candidates in locations listed by that candidate as a preferred location (including their home location) and any location which the candidate has inserted in a resume and stored on their Candidate Profile page.
16. Through Basic Talent Search, you will be able to view candidate background information, work preferences, and availability information as displayed in the Candidate Profile, subject to the candidate's visibility settings. You will not have access to a candidate's CV, direct contact information, behavioural signals, advanced filtering, or other features exclusive to Premium Talent Search.
17. The number of Basic TS Connections required to use each Basic TS Connection Method is as follows:
a. Send Job - 1 Basic TS Connection
b. Send Message - 1 Basic TS Connection
18. When you connect with a candidate using any of the Basic TS Connection Methods, you acknowledge that the candidate will receive a notification from us of such interaction. Please be aware that in all such cases, your organisation's identity and the name associated with your hirer account will be revealed to the candidate, even if you are using the "Private Advertiser" function.
19. You understand and acknowledge that a candidate's visibility settings may impact what Basic TS Connection Methods are available to you and what information you can view in their Candidate Profile.
20. Eligible Verified Hirers receive a Monthly Allocation of Basic TS Connections at no cost.
21. Your Monthly Allocation will be automatically issued to your account on the first day of each calendar month. The Monthly Allocation is issued at the Child Account level. You can check your current balance of Basic TS Connections via your SEEK employer account.
22. The amount of your Monthly Allocation may vary depending on your country or region. Details of current allocation amounts and any promotional offers are available on our website.
23. Basic TS Connections issued as part of your Monthly Allocation:
a. expire at 11:59pm (local time) on the last day of the calendar month in which they were issued;
b. do not roll over to subsequent months; and
c. cannot be transferred to another account or party.
24. If you exhaust your Monthly Allocation of Basic TS Connections before the end of the calendar month, you will be unable to use any Basic TS Connection Methods until your Monthly Allocation is refreshed on the first day of the following month.
25. We may make additional Basic TS Connections available for purchase. If purchasing options become available, details will be published on our website or communicated to you directly.
26. You agree to use the Basic Talent Search service and the information you obtain through the service:
a. for the purposes of a genuine hiring process in respect of an employment opportunity for which you are currently recruiting; and
b. in strict compliance with our Advertising Terms of Use, which includes complying with all Applicable Laws, including but not limited to, applicable Privacy Laws and anti-spam laws (capitalised terms as defined in the Advertising Terms of Use).
27. You must not use Basic Talent Search (including the Basic TS Connection Methods) or any candidate information obtained through Basic Talent Search for:
a. soliciting business from candidates and/or promoting your business or the products or services you offer other than in relation to a genuine hiring process;
b. general marketing or sales outreach;
c. scraping, harvesting, bulk-downloading or otherwise systematically copying Candidate Profiles or any personal information about candidates;
d. exporting any candidate data or Candidate Profiles obtained via Basic Talent Search outside our websites and apps, including into other databases, systems, or tools; or
e. contacting the same candidate across multiple hirer accounts in order to circumvent any limits or restrictions that apply to Basic Talent Search.
28. If we detect activity in breach of clauses 25 or 26, we reserve the right to immediately:
a. remove any live job advertisements you may have placed on our websites and apps;
b. cancel your Basic TS Connections; and
c. suspend or terminate your access to Basic Talent Search and/or other SEEK services.
29. We may at any time and at our discretion:
a. make changes to the Basic Talent Search service (including features, functionality, or the number of Basic TS Connections in the Monthly Allocation);
b. introduce paid purchasing options for additional Basic TS Connections;
c. vary the eligibility criteria for Basic Talent Search;
d. vary these Basic TS Terms; or
e. cease to offer Basic Talent Search entirely.
We will provide notice of such actions by publication on our website and/or by email or notification via the platform. Your continued use of Basic Talent Search following such changes constitutes your acceptance of the modified terms.
30. For the avoidance of doubt, the variation of terms provisions in the Advertising Terms of Use do not apply to these Basic TS Terms.
Part C: Premium Talent Search Terms and Conditions
1. These Premium Talent Search Terms and Conditions (Premium TS Terms) apply to our premium, paid version known as "Premium Talent Search".
2. While you have access to Premium Talent Search, you will also have access to the complimentary Candidate Matches service and both the Candidate Matches Terms and Conditions (see Part A above) and these Premium TS Terms will apply to you. You will not have access to Basic Talent Search while you have access to Premium Talent Search.
3. These Premium TS Terms will bind both the relevant individual and any business or organisation they represent (or claim to represent) and references to "you" and "your" (and related terms) should be read accordingly.
4. These Premium TS Terms are incorporated into the Advertising Terms of Use, which apply to you. This means that relevant provisions in the Advertising Terms of Use (such as those relating to contracting parties and governing law) also apply to these Premium TS Terms.
5. All terms defined in the Candidate Matches Terms and Conditions (see Part A above) have the same meaning in these Premium TS Terms.
6. Access Profile is an additional Connection Method only available via Premium Talent Search. When you use Access Profile in respect of a candidate, you are provided with a PDF copy of that candidate’s Candidate Profile (including their contact details, such as email address and phone number) and, where available, a copy of that candidate’s CV.
7. PTS Daily Limits means the following caps to your use of the Connection Methods:

8. Talent Search Credits means credits that can be used to access Premium Talent Search features.
9. You may purchase Premium Talent Search under a Commercial Agreement (previously known as an Advertising Agreement or Sales Agreement) with us:
a. in conjunction with an Ad Budget (Combined Agreement); or
b. as a standalone service (Standalone Credit Pack).
Please contact our Customer Service to discuss which method is available to you.
10. If you previously had access to Basic Talent Search, any Basic Talent Search entitlements you held (including any unused Basic TS Connections) will not convert into, or be credited as, Talent Search Credits or any other Premium Talent Search benefits and will not be refunded, reinstated or rolled over.
11. You will be issued the number of Talent Search Credits specified in your Combined Agreement or Standalone Credit Pack. If you have a Combined Agreement, please also refer to clauses 20 to 24 (inclusive) regarding automatic Talent Search Credit top up.
12. Premium Talent Search allows you:
a. access to the complimentary Candidate Matches service (subject to the PTS Daily Limits) as described in the Candidate Matches Terms and Conditions (see Part A above), including:
receiving up to 100 Recommended Candidates for each Qualifying Job Advertisement you post;
using Candidate Invitations to connect with these Recommended Candidates via Send Job and Send Message; and
using your Talent Search Credits to access the Access Profile feature for these Recommended Candidates, or to continue connecting with them via Send Job and Send Message if you exhaust your Candidate Invitations.
b. to search all accessible Candidate Profiles. The accessibility of a Candidate Profile is determined by:
the visibility setting the candidate has selected within their account with us; and
the location you are searching. A candidate will only be visible when you are searching for candidates in locations listed by that candidate as a preferred location (including their home location) and any location which the candidate has inserted in a resume and stored on their Candidate Profile page; and
c. to use your Talent Search Credits on any of the Connection Methods (including Access Profile) in relation to candidates that appear in your search results of the Candidate Profiles (subject to the PTS Daily Limits and any restrictions in these Premium TS Terms). You understand and acknowledge that a candidate's visibility settings may also impact what Connection Methods are available to you.
d. When you view a candidate within the Premium Talent Search product experience, you will see that candidate’s Candidate Profile, but you will not see their direct contact details (for example, their phone number or email address). A candidate’s direct contact details are only made available to you when you use the Access Profile Connection Method in respect of that candidate.
13. The number of Talent Search Credits required to use each Connection Methods within the Premium Talent Search service is as follows:
a. Send Job – 25 Talent Search Credits
b. Send Message – 50 Talent Search Credits
c. Access Profile – 200 Talent Search Credits
14. When you connect with a candidate using any of the Connection Methods, you acknowledge that the candidate will receive a notification from us of such interaction. Please be aware that in all such cases, your organisation’s identity and the name associated with your hirer account will be revealed to the candidate, even if you are using the “Private Advertiser” function.
15. You agree to use the Premium Talent Search service and the information you obtain through the service:
a. for the purposes of a genuine hiring process in respect of an employment opportunity for which you are currently recruiting; and
b. in strict compliance with our Advertising Terms of Use, which includes complying with all Applicable Laws, including but not limited to, applicable Privacy Laws and anti-spam laws (capitalised terms as defined in the Advertising Terms of Use).
16. You must not use Premium Talent Search (including the Connection Methods) or any candidate information obtained through Premium Talent Search for:
a. soliciting business from candidates and/or promoting your business or the products or services you offer other than in relation to a genuine hiring process;
b. general marketing or sales outreach;
c. scraping, harvesting, bulk-downloading or otherwise systematically copying Candidate Profiles or any personal information about candidates;
d. exporting any candidate data or Candidate Profiles obtained via Premium Talent Search outside our websites and apps, including into other databases, systems, or tools; or
e. contacting the same candidate across multiple hirer accounts in order to circumvent any limits or restrictions that apply to Premium Talent Search.
17. If we detect activity in breach of clauses 15 or 16, we reserve the right to immediately:
a. remove any live job advertisements you may have placed on our websites and apps;
b. cancel your Talent Search Credits; and
c. suspend or terminate your access to Premium Talent Search and/or other SEEK services.
18. We may make changes to, or cease to offer, the Premium Talent Search service under these Premium TS Terms (including features or functionality). We will publish notice of such actions on our website. For the avoidance of doubt, the variation of terms provisions in the Advertising Terms of Use do not apply to these Premium TS Terms.
19. Your access to Premium Talent Search may be subject to change in accordance with your Commercial Agreement with us. Any changes to the commercial model, pricing structure, or credit allocation for Premium Talent Search will be communicated to you in accordance with your Commercial Agreement.
20. Clauses 21 to 24 (inclusive) apply if you have a Combined Agreement.
21. If, at any time during your Combined Agreement, the balance on your account is reduced to 200 Talent Search Credits or less, additional Talent Search Credits will be automatically added to your account (Additional Credits). The amount of Additional Credits will be equal to the value of 10% of the Ad Budget amount under the Combined Agreement (unless otherwise stated in your Combined Agreement).
22. The charge for each increment of Additional Credits will be invoiced to you on the first day of the calendar month following the allocation of the Additional Credits, or if allocated in the final month of your Combined Agreement, invoiced as part of your final invoice.
23. You must contact us if you do not wish for Additional Credits to be allocated to you. You will be liable to pay for any Additional Credits issued before this instruction.
24. Your Talent Search Credits will expire at the end of the relevant Service Period in your Combined Agreement (unless the agreement is terminated earlier). Talent Search Credits will not be refunded or rolled over into subsequent agreements.
25. Clauses 26 to 27 (inclusive) apply if you have a Standalone Credit Pack.
26. Additional Credits will not be applied to your account in the manner described in clause 21.
27. Your agreement will conclude if you consume all Talent Search Credits before the end of the Service Period for your Standalone Credit Pack in your Commercial Agreement. Otherwise, your Talent Search Credits will expire at the end of the Service Period (unless the agreement is terminated earlier). Talent Search Credits will not be refunded or rolled over into subsequent agreements.
